Terms of service

These terms apply between Shahid Bahader IT Services, trading as Bahader Labs ("we"), and the merchant who installs the Bahader E-Invoicing app on a Shopify store ("you"). By installing or using the app you agree to them. Our privacy policy explains what data the app handles.

1. The service

The app creates invoices and credit notes for your Shopify orders as e-invoices (ZUGFeRD / Factur-X PDF, profile EN 16931, and XRechnung XML), numbers them, and lets you download, email and export them. We may improve or change features over time. We aim to keep the app available at all times but do not guarantee uninterrupted service.

2. Plans and billing

The app has a Free plan and paid plans, shown on the app's listing and in the app. Paid plans are billed by Shopify on your Shopify invoice, and Shopify's billing terms apply to charges, trials, cancellations and refunds. You can change or cancel your plan at any time in the app; uninstalling the app cancels it.

3. Your responsibilities

• You are responsible for the content of your invoices: your company details, VAT ID, small-business status and the tax rates set in your Shopify store, from which the app takes the taxes. The app checks the format against the EN 16931 and XRechnung rules, but it is not tax advice; ask your tax adviser if you are unsure.
• You must keep your invoices for as long as the law requires (usually 10 years). Export them before you uninstall the app.
• You are responsible for telling your customers how you use their data (for example in your store's privacy policy) and for having a lawful basis to collect it.
• You must not use the app for unlawful purposes or to send unsolicited marketing.

4. Liability

The app is provided "as is". To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability for any claim is limited to the amount you paid for the app in the 12 months before the claim.

5. Ending

You can stop using the app at any time by uninstalling it. We may suspend access if the app is used unlawfully or in breach of these terms. On uninstall, data is deleted as described in section 6.

6. Data processing terms

This section is our data processing agreement with you. For personal data of your customers that the app handles ("customer data"), you are the controller and we are the processor.

1. Purpose. We process customer data only to provide the app's features on your instructions, as given through the app's settings and your use of it, and for no other purpose. We do not sell customer data or use it for advertising.
2. Data. Customers' names, companies, billing and shipping addresses, email addresses, VAT IDs and order details, as listed in the privacy policy.
3. Confidentiality and access. Only the app's owner and maintainer can access the systems that hold customer data, and only when needed to run or support the app. Access to customer data in the app is logged.
4. Security. Data is sent over HTTPS. Customer names, email addresses, the invoice data and PDFs, and the app's access tokens, are encrypted in our database (AES-256-GCM), so database backups hold them only in encrypted form. Development and test data are kept separate from production data.
5. Sub-processors. Our hosting provider (OVHcloud, data centre in Canada), which runs the server and database, and our email provider (Spacemail), which delivers the app's emails. We will update this list before adding another.
6. Requests and deletion. We act on customer data requests and erasure requests that Shopify passes to us, and help you answer requests from your customers. Issued invoices are kept for your legal retention duty while the app is installed. When you uninstall the app, all of your store's data is deleted when Shopify asks us to (48 hours after uninstalling).
7. Breaches. If we become aware of a security breach affecting customer data, we will tell you without undue delay, and within 72 hours, with what we know and the steps we are taking.

7. Changes

We may update these terms. The date at the top shows the latest version; for significant changes we will tell you in the app or by email before they take effect.
